1. Acceptance of these terms

By accessing oreana.net or engaging with Oreana in any commercial capacity, you agree to be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, please refrain from using our website or services.

2. Permitted use of the website

You may use our website for personal, non-commercial browsing, for professional evaluation of our products, and for the purpose of enquiring about purchase. You may not:

• Reproduce, republish or exploit any content from the site without our prior written consent.
• Attempt to gain unauthorised access to any part of the site, its servers or its underlying infrastructure.
• Use automated systems (scrapers, crawlers) to harvest data beyond the reasonable requirements of ordinary search engines.
• Introduce malware, viruses or any harmful code into our systems.
• Use our brand assets, imagery or content in a way that could imply an affiliation, sponsorship or endorsement without our consent.

3. Accounts and enquiries

Some parts of our website may require you to submit contact information (an enquiry form, a sample-kit request). You agree that all information you provide is truthful, accurate and current. You are responsible for maintaining the confidentiality of any account or reference information we issue you.

4. Product orders and quotations

All quotations and product presentations on our website are invitations to treat, not binding offers. A binding contract of sale is formed only when you send a purchase order confirming the specifications, quantity and pricing in a written quotation, and we accept that order in writing (email confirmation is sufficient).

Natural stone products (marble, semi-precious slabs) are unique — colour, pattern and veining may vary from any sample or photograph shown. We will make reasonable efforts to match to approved samples but do not guarantee identical appearance.

5. Pricing and payment

All prices are quoted in Indian Rupees (INR) unless otherwise stated. Prices exclude GST and other statutory taxes, freight, customs duty (where applicable), and installation charges unless specifically included. Prices are valid for 30 days from the quotation date and may be revised for orders placed after that period.

Standard payment terms for confirmed orders are 40% advance on order confirmation, 40% before dispatch, and 20% on delivery (or against release documents for export shipments). Credit terms of 15–30 days may be extended to established customers at our discretion.

6. Delivery and installation

Delivery timelines quoted are estimates and are contingent on approved artwork/drawings, receipt of advance payment and availability of raw materials. Force majeure delays are covered under section 12. Title to goods passes on full payment; risk passes to the buyer on delivery (or on loading for export orders under FOB terms).

Installation services, where included, are subject to a separate installation scope document and workmanship warranty as detailed at the time of order.

7. Warranties

Engineered quartz surfaces manufactured by Oreana are warranted for 10 years (residential) or 5 years (commercial) against manufacturing defects in a normal-use environment. Warranty is void for damage caused by improper installation, chemical or mechanical abuse, unauthorised repair, or force majeure events. Natural stone products (marble, semi-precious) are warranted for material soundness at delivery. Natural weathering, use-marks, and characteristics inherent to natural stone (veining, colour variation, minor imperfections) are not defects and are not covered by warranty.

Digital tiles are warranted against manufacturing defects for 5 years from date of installation, subject to normal use and proper substrate preparation.

8. Returns and cancellations

Once a natural or semi-precious slab has been selected and prepared for shipment, cancellations are not accepted. Standard-catalogue quartz orders may be cancelled up to 5 working days after order confirmation, subject to a 15% cancellation fee to cover setup costs. Custom-colour or custom-cut items are non-cancellable and non-returnable once production has commenced.

Any damage in transit must be reported within 48 hours of delivery, with photographs. We will assess and, at our discretion, repair, replace or refund the affected slab.

9. Limitation of liability

To the maximum extent permitted by law, Oreana's total aggregate liability for any claim arising out of or related to a contract shall not exceed the total invoice value of the affected order. We shall not be liable for indirect, consequential, incidental, special or punitive damages — including lost profits, loss of use, loss of business, or downtime — however arising.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Intellectual property

All content on oreana.net — including text, images, logos, product designs, technical drawings, patterns and code — is the property of Oreana Stone & Ceramic or its licensors, protected by copyright, trademark and other intellectual property laws. You may not use, copy or reproduce any of this content without our prior written consent, except as necessary for evaluating our products for potential purchase.

Custom pattern designs supplied by you for digital-tile printing remain your intellectual property. You represent that you have the right to use them and grant us the licence necessary to produce and deliver the tiles.

11. Third-party links

Our website may contain links to third-party websites. These links are provided for convenience only. We do not endorse and are not responsible for the content, privacy practices or terms of any third-party site.

12. Force majeure

Neither party shall be liable for any failure or delay in performance caused by events beyond reasonable control, including natural disasters, pandemics, wars, terrorism, government action, port closures, strikes, and failures of essential utilities or communications infrastructure.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India. Export sales are subject to Incoterms 2020 as identified in the applicable quotation.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use of the website after publication of updated Terms constitutes acceptance of the updated Terms.
